These Terms and Conditions (“Terms”) govern (i) your access to and use of magwind.eu (the “Website”) and (ii) where applicable, your purchase and use of services provided by Magwind (“we”, “us”, “our”).

If you do not agree to these Terms, please do not use the Website.

1. Website use

You may use the Website for lawful purposes only. You agree not to:

  • misuse the Website or attempt to gain unauthorised access to systems;
  • interfere with security, performance, or availability;
  • use the Website to transmit unlawful, infringing, or harmful content.

We may suspend or restrict access to the Website if we reasonably believe you are breaching these Terms or applicable law.

2. No advice on the Website

Content on the Website is provided for general information only and does not constitute legal, tax, immigration, financial, or investment advice.

You should not rely on Website content as a substitute for tailored professional advice. Decisions involving immigration status, tax residency, and citizenship pathways depend on your facts and may change due to law, policy, and administrative practice.

3. Services

Services are provided only under agreed terms. Any Services we provide are subject to an Engagement Letter (or equivalent written scope) and any additional terms referenced in it. If there is any conflict between these Terms and an Engagement Letter, the Engagement Letter will prevail for the Services.

4. Intellectual property

All Website content and materials we provide (including text, templates, checklists, process documents, and branding) are owned by or licensed to us and are protected by intellectual property laws.

You may use deliverables for your personal/internal purposes only, and you may not reproduce, distribute, or resell them without our written consent unless the Engagement Letter states otherwise.

5. Confidentiality

We treat client information as confidential and handle it in accordance with our Privacy Policy.

6. Data protection and privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Website or Services, you acknowledge those policies.

7. Disclaimers

To the maximum extent permitted by law:

  • the Website is provided “as is” and “as available”;
  • we do not warrant uninterrupted or error-free operation;
  • we disclaim warranties implied by law, including fitness for a particular purpose, except where such disclaimers are not permitted.

8. Limitation of liability

We are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, goodwill, or business opportunity.

9. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your unlawful use of the Website, your breach of these Terms, or your provision of false/misleading information, to the extent permitted by law.

10. Right of withdrawal

If you are a consumer within the European Union, you have the right to withdraw from a distance contract within 14 days of conclusion without giving any reason, in accordance with Directive 2011/83/EU (as transposed into Portuguese law by DL 24/2014).

To exercise this right, you must inform us of your decision by a clear statement (e.g., by email to info@magwind.eu) before the withdrawal period expires. Upon valid withdrawal, we will reimburse any payments received, minus the value of any Services already performed at your express request before the withdrawal period ended.

Please note: if you have expressly requested that Services begin during the withdrawal period and you subsequently withdraw, you will be liable for an amount proportional to what has been provided up to the point you informed us of your withdrawal.

11. Professional services disclaimer

Magwind provides consultancy and coordination services. We are not a law firm, licensed immigration agency, or registered tax advisor. Where our work involves regulated activities, these are carried out by or coordinated with qualified professionals in the relevant jurisdiction.

All advice and guidance we provide is based on the information you supply to us and the rules applicable at the time. Immigration, tax, and residency rules are subject to change. Outcomes depend on individual circumstances and cannot be guaranteed. You should verify critical information with the relevant authorities.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date shows when changes were made. Continued use of the Website after changes means you accept the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of Portugal, excluding conflict-of-law rules.
